Terms of Service
Date of last revision: October 2026
PLEASE READ THESE TERMS OF SERVICE (“TERMS”) CAREFULLY. BY ACCESSING OR USING THE WEBSITE LOCATED AT VOTEHQ.ORG, INCLUDING ANY MOBILE VERSION OF IT (THE “SITE”), YOU AGREE TO BE BOUND BY THESE TERMS AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE THE SITE.
SECTION 17 CONTAINS AN AGREEMENT TO RESOLVE DISPUTES BY BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT AND EXPLAINS HOW YOU CAN OPT OUT.
1. About the Site
The Site provides general information to help people check their voter registration and prepare to vote, including resources for Native voters.
These Terms apply only to your access to and use of the Site. They form a legally binding agreement between you and American Independent Media (“AIM”). They do not change the terms of any other agreement you may have with AIM.
2. Changes to These Terms
We may revise these Terms from time to time. We will post the revised Terms on the Site and update the date of last revision above. For material changes, we will give reasonable advance notice through a prominent notice on the Site or another appropriate method and obtain additional consent where applicable law requires it.
Changes apply only from their stated effective date. They do not apply to disputes that arose before that date. Your continued use of the Site after that date means you accept the revised Terms, to the extent permitted by applicable law. Please check the Site regularly to view the current Terms.
3. Privacy Policy
Our Privacy Policy explains how we collect, use and disclose personal information in connection with the Site. Agreeing to these Terms does not by itself mean you consent to any processing of personal information that requires separate consent under applicable law.
4. Election Information; Not a Government Website
The Site is not a government website and is not affiliated with any election office. Information on the Site, including information provided through the BallotReady tool described in Section 5, is for general informational purposes only. It may be incomplete, out of date or not applicable to your situation.
Election rules, registration deadlines, polling locations, voting hours and identification requirements vary by state and locality and can change without notice. Before you rely on any information from the Site, please confirm it with your state or local election office. You can find your state or local election office at usa.gov/state-election-office.
The Site is nonpartisan. Nothing on the Site, including any candidate, ballot measure or race information provided through the BallotReady tool, is an endorsement of, or opposition to, any candidate, political party or ballot measure.
5. BallotReady Voter Tool
The Site includes a voter tool provided by BallotReady, an independent third party not affiliated with AIM (the “BallotReady Tool”). The BallotReady Tool is embedded on the Site’s homepage. When it loads, BallotReady receives information such as your IP address, browser details and the address of the page you are visiting. Information you enter into the BallotReady Tool, such as your home address, is sent directly to BallotReady, even while you are still on the Site. After you submit your address, you are taken to BallotReady’s website.
AIM can view and download information you submit through the BallotReady Tool, such as your home address, from BallotReady’s platform. Our Privacy Policy describes how AIM collects, uses and shares that information.
BallotReady’s collection and use of your information, and any communications you choose to receive from BallotReady, are governed by BallotReady’s own terms of use and privacy policy, not by these Terms or our Privacy Policy. AIM does not control, and is not responsible for, the BallotReady Tool, its content or availability, or BallotReady’s data practices.
6. Third-Party Websites and Content
Third-party websites. The Site may contain links to websites operated by others (“Third-Party Sites”). Third-Party Sites may include, for example, websites of election offices and community organizations. Third-Party Sites are not under AIM’s control. AIM makes no representation about, and accepts no responsibility for, the quality, content, nature or reliability of any Third-Party Site, including Third-Party Sites that link to the Site. We provide links only as a convenience. A link does not mean AIM is affiliated with, endorses or adopts the Third-Party Site or its content.
Your use of a Third-Party Site is governed by that site’s own terms and privacy policy, which you should review. Our Privacy Policy continues to describe AIM’s own handling of personal information, including any personal information we collect or disclose through links or embedded tools on the Site.
Third-party content. We may make information or other content provided by third parties available on or through the Site (“Third-Party Content”), including content provided through the BallotReady Tool. AIM does not control, endorse or adopt Third-Party Content, and makes no representation or warranty about it, including about its accuracy or completeness. AIM is not responsible for Third-Party Content and does not undertake to review or update it. Any dealings between you and a third party are solely between you and that third party. You use Third-Party Content at your own risk.
7. Copyright and Limited License
Unless otherwise indicated on the Site, the Site and all content and other materials on it are the property of AIM or its licensors and are protected by U.S. and international copyright laws. This includes, without limitation, AIM’s logo and all designs, text, graphics, images, information, data, software, audio and other files, and their selection and arrangement (collectively, the “Site Materials”). The BallotReady Tool and its content belong to BallotReady and are not Site Materials.
AIM grants you a limited, revocable, non-exclusive, non-transferable and non-sublicensable license to access and use the Site and the Site Materials for your personal, informational and non-commercial use only. This license is subject to these Terms and to the following restrictions. You may not:
- license, sell, rent, lease, transfer, assign, reproduce, distribute, host or otherwise commercially exploit the Site or any Site Materials;
- frame or use framing techniques to enclose any trademark, logo or other Site Materials (including images, text, page layout or form) of AIM;
- use any metatags or other “hidden text” using AIM’s name or trademarks;
- modify, translate, adapt, merge, make derivative works of, disassemble, decompile, reverse compile or reverse engineer any part of the Site Materials, except to the extent applicable law expressly prohibits this restriction;
- use any manual or automated software, device or process (including spiders, robots, scrapers, crawlers, data mining tools or similar tools) to scrape or download data from the Site, except that operators of public search engines may use spiders to copy materials from the Site solely to create publicly available searchable indexes, and not caches or archives, and AIM may revoke this permission at any time;
- access the Site Materials to build a similar or competitive website or service;
- except as expressly permitted in these Terms, copy, reproduce, distribute, republish, download, display, post or transmit any part of the Site Materials in any form or by any means;
- remove or destroy any copyright notice or other proprietary marking on the Site Materials; or
- use the Site or any Site Materials to develop, train, test or improve any artificial intelligence system without AIM’s prior written consent.
Any use of the Site or Site Materials not expressly authorized in these Terms, without AIM’s prior written permission, is prohibited and will end the license granted above. Unauthorized use may also violate applicable law, including copyright and trademark law. Except as expressly stated in these Terms, nothing in these Terms grants any license to any intellectual property right, whether by estoppel, implication or otherwise.
8. Copyright Complaints
If you believe anything on the Site infringes a copyright you own or control, you may send a notice of claimed infringement to our designated agent:
- Designated agent: Marisha Kirtane
- Mailing address: 800 Maine Avenue SW, Suite 400, Washington, DC 20024
- Telephone: 202-240-2346
- Email: AIM@tainews.com
Please see 17 U.S.C. § 512(c)(3) for the requirements of a proper notice. If you knowingly misrepresent in your notice that material or activity is infringing, you may be liable for any resulting damages, including costs and attorneys’ fees, incurred by us or the alleged infringer as a result of our relying on that misrepresentation to remove or disable access to the material.
In accordance with the Digital Millennium Copyright Act (“DMCA”) and other applicable law, AIM may, in appropriate circumstances and at its sole discretion, limit or block access to the Site by anyone who repeatedly infringes the intellectual property rights of others.
9. Trademarks
AIM’s name, stylized name and all related graphics, logos, slogans, service marks and trade names used on or in connection with the Site are trademarks of AIM. They may not be used without AIM’s permission in connection with any of your or any third party’s products or services. Other trademarks, service marks and trade names that may appear on the Site belong to their respective owners.
The look and feel of the Site, including page headers, custom graphics, button icons and scripts, is the service mark, trademark or trade dress of AIM. It may not be copied, imitated or used, in whole or in part, without our prior written permission. A reference on the Site to any product, service, process or other information by trade name, trademark, manufacturer, supplier or otherwise does not mean AIM endorses, sponsors or recommends it.
10. User Conduct
As a condition of using the Site, you agree not to use the Site or Site Materials for any purpose prohibited by these Terms or by applicable law. You will not, and will not permit any third party to:
- infringe any patent, trademark, trade secret, copyright, right of publicity or other right of any person or entity;
- use the Site in a way that is unlawful, threatening, abusive, harassing, defamatory, deceptive, fraudulent or invasive of another’s privacy;
- impersonate any person or entity, including any employee or representative of AIM;
- interfere or attempt to interfere with the proper functioning of the Site, or use the Site in any way not expressly permitted by these Terms; or
- engage or attempt to engage in any harmful act directed at the Site, including violating or attempting to violate any security feature of the Site, introducing viruses, worms or other harmful code, or interfering with the use of the Site by any other user, host or network, including by overloading, flooding or crashing the Site.
11. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless AIM and its affiliates, and its and their directors, officers, employees, agents, suppliers and licensors (each, an “AIM Party” and together, the “AIM Parties”), from third-party claims, liabilities, damages and reasonable costs and expenses, including attorneys’ fees, arising from your violation of these Terms, your violation of applicable law or your infringement of another person’s rights. This obligation does not apply to the extent a claim arises from an AIM Party’s negligence, willful misconduct or violation of applicable law.
AIM may, at its own cost, assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will cooperate with AIM in asserting any available defenses. This section does not require you to indemnify any AIM Party for that party’s unconscionable commercial practice, fraud, deception, false promise, misrepresentation, or concealment, suppression or omission of any material fact in connection with the Site. This section survives any termination of your access to the Site.
12. Disclaimers
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOUR USE OF THE SITE AND THE SITE MATERIALS IS AT YOUR SOLE RISK. THE SITE, THE SITE MATERIALS AND ANY SERVICES PROVIDED ON OR THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. AIM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OR CONTENT ON OR ACCESSED THROUGH THE SITE. AIM DOES NOT REPRESENT OR WARRANT THAT THE SITE OR THE SITE MATERIALS ARE ACCURATE, COMPLETE, RELIABLE, CURRENT OR ERROR-FREE, INCLUDING ANY ELECTION OR VOTER INFORMATION.
AIM IS NOT RESPONSIBLE FOR TYPOGRAPHICAL ERRORS OR OMISSIONS. AIM DOES NOT REPRESENT OR WARRANT THAT THE SITE OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. AIM IS NOT RESPONSIBLE FOR THE BALLOTREADY TOOL, ANY THIRD-PARTY SITE OR ANY THIRD-PARTY CONTENT.
13. Limitation of Liability
TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ANY AIM PARTY BE LIABLE FOR ANY LOSS OF DATA OR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, WHETHER OR NOT AIM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, ON ANY THEORY OF LIABILITY, RESULTING FROM: (1) THE USE OF OR INABILITY TO USE THE SITE OR THE SITE MATERIALS; (2) ANY RELIANCE ON INFORMATION OBTAINED THROUGH THE SITE; (3) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (4) THE STATEMENTS, CONDUCT OR SERVICES OF ANY THIRD PARTY, INCLUDING BALLOTREADY; OR (5) ANY OTHER MATTER RELATING TO THE SITE, WHETHER BASED ON WARRANTY, COPYRIGHT, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER LEGAL THEORY.
UNDER NO CIRCUMSTANCES WILL THE AIM PARTIES’ TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED U.S. DOLLARS ($100).
THE EXCLUSIONS AND LIMITATIONS IN THIS SECTION DO NOT APPLY TO AN AIM PARTY’S LIABILITY FOR (A) DEATH OR PERSONAL INJURY CAUSED BY THAT AIM PARTY’S NEGLIGENCE, (B) ANY INJURY CAUSED BY THAT AIM PARTY’S FRAUD OR FRAUDULENT MISREPRESENTATION, OR (C) ANY OTHER LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED. THE LIMITATIONS IN THIS SECTION ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN AIM AND YOU.
14. Users Outside the United States
The Site is intended for people in the United States. AIM makes no representation that the Site or the Site Materials are appropriate or available for use in other locations. If you access the Site from outside the United States, you do so on your own initiative and are responsible for complying with local law.
15. Applicable Law and Venue
These Terms are governed by the laws of the District of Columbia, without regard to conflict of laws principles, except that the Federal Arbitration Act governs Section 17. Subject to Section 17 and any rights you have under applicable law that cannot be waived, any action arising out of or relating to these Terms or the Site must be brought in the state or federal courts located in the District of Columbia, and you and AIM consent to the jurisdiction of those courts.
16. Informal Dispute Resolution
Before starting a proceeding, either party may notify the other of a dispute. You may contact us at privacy@votehq.org with a description of the dispute and the relief you are requesting. The parties will try in good faith to resolve the dispute within 60 days. This process does not prevent either party from making a timely filing to preserve a claim, or from seeking relief that cannot lawfully be delayed.
17. Binding Arbitration
EXCEPT AS STATED BELOW, YOU AND AIM AGREE TO RESOLVE ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN A TRIAL IN COURT.
Arbitration will be administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules, available at www.adr.org, before a single arbitrator. The arbitrator may award any relief available under applicable law. Fees and costs will be allocated under the applicable AAA rules and fee schedule, and AIM will pay any additional amount required by applicable law. Hearings may be held remotely or at a location reasonably convenient to you, as provided by the applicable rules. Judgment on an award may be entered in any court of competent jurisdiction.
Either party may bring an eligible individual claim in small claims court instead. This agreement does not restrict reports to government agencies or any claim or remedy that applicable law does not permit to be arbitrated. If AAA cannot administer a dispute and the parties cannot agree on an alternative provider consistent with applicable law, either party may bring the dispute in a court described in Section 15.
You may opt out of this arbitration agreement by sending your name, contact information and a clear opt-out request to privacy@votehq.org within 30 days after you first agree to these Terms. Opting out will not affect the rest of these Terms.
18. Termination
AIM may, without notice and at its sole discretion, terminate your license to use the Site and block or prevent your future access to and use of the Site.
19. Assignment
You may not assign, delegate or otherwise transfer these Terms or any of your rights or obligations under them without AIM’s prior written consent. Any attempt to do so without that consent is void.
20. Force Majeure
AIM is not liable for any delay or failure to perform resulting from causes outside its reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or failures of internet, hosting or other third-party services.
21. Severability
If any provision of these Terms is found unlawful, void or unenforceable for any reason, that provision will be severed from these Terms and will not affect the validity and enforceability of the remaining provisions.
22. Entire Agreement
These Terms, together with our Privacy Policy, are the final, complete and exclusive agreement between you and AIM regarding the Site. They supersede all prior discussions between you and AIM regarding the Site.
23. Contact Us
Questions or comments about the Site or these Terms may be sent to AIM at privacy@votehq.org.
